End-User License Agreement: Cybertection GuardBot (Linux - Snapcraft)

Welcome to Cybertection GuardBot for Linux. By downloading, installing, or using our application through Snapcraft, you agree to be bound by this End-User License Agreement ("EULA" or "Agreement"). Please read this carefully before using the software.
1. Acceptance of Terms
By installing, downloading, accessing, or using Cybertection GuardBot ("the Software" or "the Application"), you acknowledge that you have read, understood, and agree to be bound by this EULA and our Privacy Policy. If you do not agree to these terms, do not install, download, access, or use the Software.
2. License Grant
Cybertection LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on Linux systems that you own or control, solely for personal or internal business purposes, subject to the terms of this Agreement.
You May:

Install the Software on multiple Linux systems that you own or control

Use all features included in your subscription tier or license

Receive automatic updates and security patches through Snapcraft

Make backup copies for archival purposes
Prohibited Actions:

Commercial Redistribution: Reselling, sublicensing, renting, leasing, or distributing the Software to third parties for commercial gain without explicit written permission from Cybertection LLC

Reverse Engineering: Reverse engineering, decompiling, disassembling, or attempting to extract the source code of the Software (except as explicitly permitted by applicable open-source licenses for included components or as required by applicable law)

Modification: Modifying, altering, or creating derivative works based on the Software's proprietary components
-
Circumvention: Attempting to bypass, disable, or circumvent any security features, license verification, or usage restrictions
-
Harmful Use: Using the Software in any manner that violates applicable laws or regulations, or in ways that could harm other users or systems
-
Service Abuse: Using the Software in ways that place unreasonable burden on Cybertection's servers or services
Violation of these terms may result in the immediate termination of this license and potential legal action.

Price Changes:
Cybertection LLC reserves the right to modify subscription pricing with 30 days' advance notice. Price changes will not affect your current subscription period but will apply to subsequent renewals.
5. Privacy and Data Collection
Your privacy is important to us. Our Privacy Policy describes how we collect, use, store, and protect your information when you use Cybertection GuardBot.

Update Control:

Linux users have more granular control over updates through snap settings

Some updates may require system services to restart

Critical security updates may be enforced for all users
Warning: Disabling automatic updates may leave your system vulnerable to emerging security threats.
7. Linux-Specific Provisions

Snap confinement permissions are documented in the snap manifest and can be reviewed before installation.
Open Source Components:
Cybertection GuardBot may include or link to open-source components. These components are governed by their respective licenses (GPL, MIT, Apache, etc.), which are included in the Software distribution and available at: /snap/cybertection-guardbot/current/licenses/
The proprietary portions of the Software remain the exclusive property of Cybertection LLC.

8. Intellectual Property Rights
Ownership:
All proprietary content, features, functionality, software code, algorithms, user interface design, graphics, logos, trademarks, and other materials contained within Cybertection GuardBot (excluding open-source components) are the exclusive property of Cybertection LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
Trademarks:
"Cybertection," "GuardBot," and associated logos are trademarks of Cybertection LLC. Unauthorized use is strictly prohibited.
Open Source Compliance:
Where the Software includes open-source components, those components remain under their original licenses. This EULA applies only to the proprietary portions of the Software developed by Cybertection LLC.

9. Security Disclaimers & Service Limitations
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
No Absolute Protection:
No security software can provide 100% protection against all threats. You acknowledge that:

Detection Limitations: The Software may not detect all malware, including zero-day threats and advanced persistent threats

VPN Limitations: The VPN service enhances privacy but does not guarantee complete anonymity
-
Performance Impact: Security scanning may impact system performance, particularly during active scans
-
False Positives: Legitimate software may occasionally be flagged as suspicious
User Responsibilities:
You remain responsible for:

Maintaining system backups

Keeping your Linux distribution and software updated

Following security best practices
-
Configuring appropriate firewall rules

Reviewing and understanding the Software's security settings
Third-Party Software:
Cybertection GuardBot may interact with or scan third-party software. We are not responsible for:

Compatibility issues with other security software

Conflicts with system configurations

Issues arising from modified or custom Linux kernels
YOU ACKNOWLEDGE THAT USE OF THE SOFTWARE DOES NOT ELIMINATE ALL SECURITY RISKS AND THAT YOU USE IT AT YOUR OWN RISK.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBERTECTION LLC SHALL NOT BE LIABLE FOR ANY:

Indirect, Incidental, Special, Consequential, or Punitive Damages

Loss of Data, Profits, or Business Opportunities
-
System Downtime or Performance Degradation
-
Damage Resulting from Malware Not Detected by the Software

Issues Arising from Software Conflicts or System Misconfigurations

Damages Caused by User Error or Improper Use
This limitation applies regardless of legal theory (contract, tort, negligence, strict liability, or otherwise), even if Cybertection LLC has been advised of the possibility of such damages.
Maximum Liability:
In jurisdictions where liability cannot be completely excluded, Cybertection LLC's total liability shall not exceed the amount you paid for the Software in the twelve (12) months preceding the event, or $100 USD, whichever is less.
11. Acceptable Use Policy
You agree to use the Software only for lawful purposes. Specifically, you agree NOT to:

Illegal Activities: Use the Software to engage in or facilitate any illegal activities

Copyright Infringement: Use the VPN to unlawfully access or distribute copyrighted content

Malicious Activities: Create, distribute, or facilitate distribution of malware

Unauthorized Access: Attempt to hack, breach, or gain unauthorized access to systems or networks

Harassment: Use the Software to harass, threaten, or harm others
-
Network Abuse: Engage in DDoS attacks, spamming, or other network abuse
-
Service Abuse: Attempt to reverse engineer our threat detection algorithms or abuse our services
-
Resale: Resell VPN or security services to third parties without authorization
Violation of this policy may result in immediate license termination and legal action.
12. Termination
Termination by Cybertection LLC:
We may terminate this license if:

You violate any terms of this Agreement

You engage in prohibited activities
-
Your account shows evidence of abuse or fraudulent activity
-
We discontinue the Software (with reasonable notice)
-
Required by law or legal process
Termination by You:
You may terminate this license at any time by:

Uninstalling the Software: sudo snap remove cybertection-guardbot
-
Canceling your subscription through your account portal
-
Contacting support to request account closure
Effect of Termination:
Upon termination:

Your license to use the Software immediately ceases
-
Premium features will be disabled
-
You must uninstall the Software from all systems
-
Certain provisions (Sections 8, 10, 13, 14) survive termination
-
No refunds for unused subscription time (except as required by law or our refund policy)
13. Governing Law & Dispute Resolution
Governing Law:
This Agreement shall be governed by the laws of the State of Maryland, United States, without regard to conflict of law principles.
Jurisdiction:
Any disputes shall be resolved in the courts of Queen Anne's County, Maryland. You consent to personal jurisdiction in these courts.
Informal Resolution:
Before filing any legal claim, you agree to contact us at support@cybertection-guardbot.com to attempt informal resolution within 30 days.
Arbitration:
If informal resolution fails, disputes may be resolved through binding arbitration under the rules of the American Arbitration Association, except for:

Claims related to intellectual property rights

Claims for injunctive or equitable relief
Limitation Period:
Claims must be filed within one (1) year of the event giving rise to the claim.
Class Action Waiver:
To the extent permitted by law, all disputes shall be resolved individually. You waive rights to class action lawsuits or class-wide arbitration.

Cybertection LLC may modify this EULA to reflect:

Notice of Changes:

Acceptance:
Continued use of the Software after changes constitutes acceptance of modified terms. If you disagree, you must stop using the Software and may request a prorated refund for unused subscription time.
15. Snapcraft-Specific Terms
Distribution:
This Software is distributed through the Snap Store. By installing from Snapcraft, you also agree to Canonical's Snap Store Terms of Service.
Updates:
Software updates are delivered through the snap refresh mechanism. Update frequency and channels can be configured using snap commands.
Confinement:
The Software operates within snap confinement boundaries. Required interfaces and permissions are declared in the snap manifest.
Support Channels:

Snap-specific issues can be reported through the Snap Store or our support portal

General Linux support available to all paid subscribers
16. Export Control
The Software may be subject to export control laws. You agree to comply with all applicable export and import laws and regulations, including but not limited to U.S. Export Administration Regulations.
You represent that you are not:

Located in a country subject to U.S. government embargo

Listed on any U.S. government list of prohibited or restricted parties

Using the Software for prohibited end uses (e.g., nuclear, chemical, or biological weapons development)
17. Severability
If any provision of this Agreement is found invalid or unenforceable, that provision shall be modified to the minimum extent necessary or severed, and the remaining provisions shall continue in full force.
18. Entire Agreement
This EULA, together with our Privacy Policy (https://www.cybertection.net/privacy-policy), constitutes the entire agreement between you and Cybertection LLC regarding the Software, superseding all prior agreements.
