Welcome to Cybertection GuardBot for Windows. By downloading, installing, or using our application from the Microsoft Store, you agree to be bound by these Terms of Service and End-User License Agreement ("Terms"). Please read them carefully before using the app.

PART A: TERMS OF SERVICE

1. Acceptance of Terms

By accessing or using Cybertection GuardBot ("the App" or "the Software"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

2. License Agreement

This App is licensed, not sold. By downloading Cybertection GuardBot from the Microsoft Store, you agree to Microsoft's Standard Application License Terms, which govern your use of applications distributed through the Microsoft Store.

In the event of any conflict between these Terms and Microsoft's terms, Microsoft's terms shall take precedence with respect to your use of the App through the Microsoft Store.

3. Subscription Tiers & Services

Cybertection GuardBot provides comprehensive security services through three distinct subscription tiers. Your access to specific features depends on your chosen subscription level.

The Free Tier is available immediately upon download. Premium features require an active subscription purchased through the Microsoft Store.

4. In-App Purchases and Billing

All subscriptions (Basic and Pro) are processed exclusively through your Microsoft account via the Microsoft Store.

Subscription Terms:

Payment: Your Microsoft account will be charged upon confirmation of purchase.

Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected subscription plan.

Free Trial: If a Pro subscription offers a free trial period (typically 3 days), your Microsoft account will be charged when the free trial ends unless auto-renewal is disabled at least 24 hours before the trial expires. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Refunds: Refunds are subject to Microsoft Store's refund policy. To request a refund, contact Microsoft Store support. Cybertection LLC does not control Microsoft's refund decisions.

Price Changes: Cybertection LLC reserves the right to modify subscription pricing with advance notice. Price changes will apply to subsequent billing periods following notice to you.

5. Privacy Policy

Your privacy is extremely important to us. Our Privacy Policy describes how we collect, use, store, and protect your personal information when you use Cybertection GuardBot, including our VPN Webguard service.

By using this App, you consent to the data practices described in our Privacy Policy.

6. Security Disclaimers & Service Limitations

CYBERTECTION GUARDBOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

While our antivirus, real-time protection, and VPN tools are designed with industry-leading security practices to enhance your digital safety and privacy, you acknowledge and agree that:

No Absolute Protection: No security software, including Cybertection GuardBot, can provide 100% protection against all malware, viruses, cyber threats, or security vulnerabilities. New threats emerge constantly, and detection requires ongoing updates.
Scanning Limitations: Security scanning may not detect all malware, spyware, ransomware, or other malicious software. Zero-day threats and sophisticated attacks may evade detection.
VPN Service: The VPN Webguard service is provided for encrypted browsing and enhanced privacy but does not guarantee complete anonymity or protection from all online threats. VPN performance may vary based on network conditions, server load, and geographic location.
Windows Defender Compatibility: Cybertection GuardBot is designed to work alongside Windows Defender. Some features may require Windows Defender to be enabled for optimal protection.
System Requirements: The App requires Windows 10 version 1809 or higher. Performance may vary based on system specifications and available resources.
User Responsibility: You remain solely responsible for:
- Practicing safe browsing habits
- Maintaining regular backups of your important data
- Keeping Windows and all software updated
- Using strong, unique passwords
- Exercising caution when downloading files or clicking links
- Not disabling Windows security features unnecessarily
Service Availability: The App and its services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We do not guarantee uninterrupted or error-free service.
Third-Party Content: Cybertection GuardBot may interact with third-party websites, services, or content. We are not responsible for the security, privacy practices, or content of third-party services.
System Performance: Security features, particularly real-time scanning and VPN services, may impact system performance and resource usage. You can adjust settings to balance security and performance.

YOU ACKNOWLEDGE THAT USE OF CYBERTECTION GUARDBOT DOES NOT ELIMINATE ALL SECURITY RISKS AND THAT YOU USE THE APP AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBERTECTION LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

Indirect, Incidental, Special, Consequential, or Punitive Damages
Loss of Profits, Revenue, Data, or Business Opportunities
Business Interruption or System Downtime
Security Breaches, Data Loss, or Privacy Violations Occurring Despite Use of Our Software
Costs of Procurement of Substitute Services
Damages Resulting from Malware, Viruses, or Other Harmful Code Not Detected by the App
Unauthorized Access to Your Device or Accounts
Damages Arising from VPN Service Interruptions or Performance Issues
System Malfunction, Performance Degradation, or Data Corruption
Compatibility Issues with Other Software or Hardware

This limitation applies regardless of the legal theory upon which any claim is based (whether contract, tort, negligence, strict liability, or otherwise), even if Cybertection LLC has been advised of the possibility of such damages.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

In jurisdictions where liability cannot be excluded, Cybertection LLC's total liability to you for all claims arising from or related to the App shall not exceed the amount you paid for the App subscription in the twelve (12) months preceding the event giving rise to liability, or $100 USD, whichever is less.

PART B: END-USER LICENSE AGREEMENT

8. License Grant

Cybertection LLC grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software on Windows devices that you own or control, solely for personal, non-commercial purposes, subject to these Terms.

You May:

Install the Software on multiple Windows devices associated with your Microsoft account
Use all features included in your subscription tier
Receive automatic updates and security patches

Prohibited Actions:

Commercial Use: Using the Software for commercial purposes without explicit written permission from Cybertection LLC
Reverse Engineering: Reverse engineering, decompiling, disassembling, or attempting to extract the source code of the Software (except as permitted by applicable law)
Modification: Modifying, altering, or creating derivative works based on the Software
Distribution: Reselling, sublicensing, renting, leasing, or distributing the Software to third parties
Circumvention: Attempting to bypass, disable, or circumvent any security features, license verification, or usage restrictions
Harmful Use: Using the Software in any manner that violates applicable laws or regulations

Violation of these terms may result in the immediate termination of this license and legal action.

9. Intellectual Property Rights

All content, features, functionality, software code, algorithms, user interface design, graphics, logos, trademarks, service marks, and other materials contained within Cybertection GuardBot are the exclusive property of Cybertection LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Ownership:

Cybertection LLC and its licensors retain full ownership of the Software and all related intellectual property rights. This license does not grant you any rights, title, or interest in the Software except for the limited license explicitly stated in these Terms.

Trademarks:

"Cybertection," "GuardBot," "Cybertection GuardBot," and associated logos are trademarks of Cybertection LLC. Unauthorized use is strictly prohibited and may result in legal action.

The license granted to you is limited to a non-exclusive, non-transferable, revocable right to use the Software for personal, non-commercial purposes in accordance with these Terms.

10. Software Updates and Maintenance

Automatic Updates:

To ensure optimal security and performance, Cybertection GuardBot may automatically download and install updates, including:

Security patches to address vulnerabilities
Virus definition database updates
New features and improvements
Bug fixes and performance enhancements
Critical security updates

By using the Software, you consent to receive and allow automatic updates without prior notice. These updates are essential for maintaining protection against emerging threats.

Manual Updates:

You may also check for updates manually through the App's settings. However, automatic updates are strongly recommended for maintaining optimal security.

Update Requirements:

Updates may require an active internet connection
Some updates may require system restart
Failure to install updates may result in reduced functionality, security vulnerabilities, or degraded protection

Disabling automatic updates is strongly discouraged and may leave your system vulnerable to security threats.

11. Acceptable Use Policy

You agree to use Cybertection GuardBot only for lawful purposes and in compliance with these Terms. Specifically, you agree NOT to use the Software or VPN Webguard service to:

Prohibited Activities:

Illegal Activities: Engage in any activity that violates local, state, national, or international laws or regulations, including but not limited to laws governing data privacy, intellectual property, export control, or cybercrime.
Copyright Infringement: Bypass geographic restrictions, VPN detection systems, or access controls to unlawfully access, download, stream, or distribute copyrighted content (movies, music, software, etc.) without proper authorization.
Malicious Activities: Distribute, upload, transmit, or create malware, viruses, ransomware, spyware, trojans, worms, or any other harmful or malicious code.
Unauthorized Access: Attempt to gain unauthorized access to computer systems, networks, servers, accounts, or data belonging to others. This includes hacking, phishing, password cracking, or exploiting security vulnerabilities.
Harassment or Harm: Harass, threaten, stalk, intimidate, abuse, defame, or cause harm to any individual or entity.
Network Abuse: Engage in any activity that disrupts, interferes with, or places excessive load on our servers, the Software, or networks connected to the service, including denial-of-service attacks, flooding, or spamming.
Fraud or Deception: Impersonate any person or entity, misrepresent your affiliation with any person or entity, or engage in fraudulent activities.
Child Exploitation: Create, access, store, or distribute content involving the exploitation or abuse of minors.
Terrorism or Violence: Use the service to plan, promote, or engage in terrorism, violent extremism, or activities that threaten public safety.
Resale or Redistribution: Resell, redistribute, or provide access to the Software or VPN service to third parties without authorization.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your license and access to the Software, with or without notice, and may be reported to appropriate law enforcement authorities.

12. Termination

Termination by Cybertection LLC:

We reserve the right to suspend, restrict, or terminate your license and access to Cybertection GuardBot, with or without notice, if:

You violate any provision of these Terms
You engage in prohibited activities as outlined in the Acceptable Use Policy
You use the Software or VPN service for illegal purposes
Your account shows evidence of fraudulent activity
We detect unauthorized modifications to the Software
We are required to do so by law or legal process
We discontinue the Software or specific features (with reasonable notice when possible)

Upon termination for cause, Cybertection LLC may also remotely disable the Software.

Termination by You:

You may cancel your subscription at any time through the Microsoft Store:

Find Cybertection GuardBot
Select Cancel subscription

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that date.

You may also uninstall the Software from your device at any time through Windows Settings.

Effect of Termination:

Upon termination or expiration of your subscription:

Your access to premium features (Real-time Shield, VPN Webguard, advanced tools) will immediately cease
You will revert to Free Tier access only
The Software may remain installed on your device but with limited functionality
You must immediately cease all use of the Software if your license is terminated for cause
Refunds are subject to Microsoft Store's refund policy
Certain provisions of these Terms (including Sections 7, 9, 13, and 14) shall survive termination

13. Governing Law & Dispute Resolution

Governing Law:

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, United States of America, without regard to its conflict of law principles.

Jurisdiction:

Any legal action, suit, or proceeding arising out of or relating to these Terms or the Software shall be instituted exclusively in the federal or state courts located in Queen Anne's County, Maryland. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Dispute Resolution:

Before filing any legal claim, you agree to first contact us at support@cybertection-guardbot.com to attempt to resolve the dispute informally. We will work in good faith to resolve any concerns within 30 days.

If informal resolution fails, disputes may be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Limitation Period:

Any claim or cause of action arising from or related to your use of the Software must be filed within one (1) year after the claim or cause of action arose, or such claim shall be permanently barred.

Class Action Waiver:

To the extent permitted by law, all disputes shall be resolved on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against Cybertection LLC.

14. Changes to These Terms

Cybertection LLC reserves the right to modify, update, or replace these Terms at any time at our sole discretion. Changes may be necessary due to:

Legal or regulatory requirements
New features or services
Security enhancements
Policy updates

Notice of Changes:

When we make material changes to these Terms, we will:

Update the "Last Updated" date at the top of this document
Notify you through the Software via in-app notification, and/or
Post notice on our website at www.cybertection.net

Acceptance of Changes:

Your continued use of Cybertection GuardBot after changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the Software and cancel your subscription.

We encourage you to review these Terms periodically to stay informed of any updates.

15. Windows-Specific Provisions

System Requirements:

Operating System: Windows 10 version 1809 or higher, Windows 11
Processor: 1 GHz or faster processor
RAM: Minimum 2 GB (4 GB recommended)
Disk Space: Minimum 500 MB available space
Internet Connection: Required for updates, VPN, and cloud features

Compatibility:

The Software is designed to work alongside Windows Defender and other security software
Some features may require administrator privileges
Certain enterprise or modified Windows installations may not be fully supported

Data Storage:

The Software stores configuration data in standard Windows directories
Scan logs and quarantine files are stored locally on your device
You are responsible for backing up any critical data before using the Software

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, Microsoft's Standard Application License Terms, and the EULA referenced at https://www.cybertection.net/service-user-agreement, constitute the entire agreement between you and Cybertection LLC regarding your use of the Software and supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral.

19. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING CYBERTECTION GUARDBOT, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND END-USER LICENSE AGREEMENT, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM.
