Terms of Service: Cybertection GuardBot (Android)

Welcome to Cybertection GuardBot for Android. By downloading, installing, or using our application from Google Play, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the app.

1. Acceptance of Terms

By accessing or using Cybertection GuardBot ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

2. License Agreement

This App is licensed, not sold. By downloading Cybertection GuardBot from Google Play, you agree to Google's Terms of Service for Google Play, which govern your use of applications distributed through Google Play.

In the event of any conflict between these Terms and Google's Terms of Service, Google's Terms shall take precedence with respect to your use of the App on Android devices.

3. Subscription Tiers & Services

Cybertection GuardBot provides comprehensive security services through three distinct subscription tiers. Your access to specific features depends on your chosen subscription level.

Free Tier:

Basic manual antivirus scanning
Limited security tools
No real-time protection
No scheduled scanning
No VPN Webguard access

Basic Subscription (Monthly/Yearly):

Full deep antivirus scanning
Real-time Shield protection
Scheduled scanning capabilities
All advanced security tools (70+ modules)
Advanced threat detection including Deepfake Scanner
No VPN Webguard access

Pro / Full Security Subscription (Monthly/Yearly):

All Basic Subscription features
Complete VPN Webguard access with encrypted browsing
Unrestricted access to all premium security modules
Priority customer support
Advanced privacy protection tools

The Free Tier is available immediately upon download. Premium features require an active subscription purchased through Google Play.

4. In-App Purchases and Billing

All subscriptions (Basic and Pro) are processed exclusively through your Google Play account.

Subscription Terms:

Payment: Your Google Play account will be charged upon confirmation of purchase.

Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected subscription plan.

Free Trial: If a Pro subscription offers a free trial period (typically 3 days), your Google Play account will be charged when the free trial ends unless auto-renewal is disabled at least 24 hours before the trial expires. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Subscription Management: You can manage your subscriptions and turn off auto-renewal through your Google Play account settings:

Open the Google Play Store app
Tap Menu → Subscriptions
Select Cybertection GuardBot
Tap Cancel subscription or Manage

Refunds: Refunds are subject to Google Play's refund policy. To request a refund, contact Google Play support directly. Cybertection LLC does not control Google Play's refund decisions.

Price Changes: Cybertection LLC reserves the right to modify subscription pricing with advance notice. Price changes will apply to subsequent billing periods following notice to you.

5. Privacy Policy

Your privacy is extremely important to us. Our Privacy Policy describes how we collect, use, store, and protect your personal information when you use Cybertection GuardBot, including our VPN Webguard service.

By using this App, you consent to the data practices described in our Privacy Policy.

6. Security Disclaimers & Service Limitations

CYBERTECTION GUARDBOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

While our antivirus, real-time protection, and VPN tools are designed with industry-leading security practices to enhance your digital safety and privacy, you acknowledge and agree that:

No Absolute Protection: No security software, including Cybertection GuardBot, can provide 100% protection against all malware, viruses, cyber threats, or security vulnerabilities. New threats emerge constantly, and detection requires ongoing updates.
Scanning Limitations: Security scanning may not detect all malware, spyware, ransomware, or other malicious software. Zero-day threats and sophisticated attacks may evade detection.
VPN Service: The VPN Webguard service is provided for encrypted browsing and enhanced privacy but does not guarantee complete anonymity or protection from all online threats. VPN performance may vary based on network conditions, server load, and geographic location.
Android Permissions: The App requires certain Android permissions to function properly. These permissions are used solely for security scanning and protection features. Denying required permissions may limit functionality.
User Responsibility: You remain solely responsible for:
- Practicing safe browsing habits
- Maintaining regular backups of your important data
- Keeping your device's operating system updated
- Using strong, unique passwords
- Exercising caution when downloading apps or clicking links
- Reviewing app permissions before installation
Service Availability: The App and its services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We do not guarantee uninterrupted or error-free service.
Third-Party Content: Cybertection GuardBot may interact with third-party websites, services, or content. We are not responsible for the security, privacy practices, or content of third-party services.
Battery and Performance: Security features, particularly real-time scanning and VPN services, may impact battery life and device performance. You can adjust settings to balance security and performance.

YOU ACKNOWLEDGE THAT USE OF CYBERTECTION GUARDBOT DOES NOT ELIMINATE ALL SECURITY RISKS AND THAT YOU USE THE APP AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBERTECTION LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

Indirect, Incidental, Special, Consequential, or Punitive Damages
Loss of Profits, Revenue, Data, or Business Opportunities
Business Interruption or System Downtime
Security Breaches, Data Loss, or Privacy Violations Occurring Despite Use of Our Software
Costs of Procurement of Substitute Services
Damages Resulting from Malware, Viruses, or Other Harmful Code Not Detected by the App
Unauthorized Access to Your Device or Accounts
Damages Arising from VPN Service Interruptions or Performance Issues
Device Malfunction, Battery Drain, or Performance Degradation

This limitation applies regardless of the legal theory upon which any claim is based (whether contract, tort, negligence, strict liability, or otherwise), even if Cybertection LLC has been advised of the possibility of such damages.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

In jurisdictions where liability cannot be excluded, Cybertection LLC's total liability to you for all claims arising from or related to the App shall not exceed the amount you paid for the App subscription in the twelve (12) months preceding the event giving rise to liability, or $100 USD, whichever is less.

8. Intellectual Property Rights

All content, features, functionality, software code, user interface design, graphics, logos, trademarks, service marks, and other materials contained within Cybertection GuardBot are the exclusive property of Cybertection LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You May Not:

Copy, modify, distribute, sell, or lease any part of the App or its content
Reverse engineer, decompile, or disassemble the App software (except as permitted by applicable law)
Extract source code or attempt to derive the underlying algorithms
Remove, alter, or obscure any copyright, trademark, or proprietary notices
Create derivative works based on the App
Use the App's name, logo, or trademarks without prior written permission
Frame or mirror any part of the App without express authorization

"Cybertection," "GuardBot," and associated logos are trademarks of Cybertection LLC. Unauthorized use is strictly prohibited and may result in legal action.

The license granted to you is limited to a non-exclusive, non-transferable, revocable right to use the App for personal, non-commercial purposes in accordance with these Terms.

9. Acceptable Use Policy

You agree to use Cybertection GuardBot only for lawful purposes and in compliance with these Terms. Specifically, you agree NOT to use the App or VPN Webguard service to:

Prohibited Activities:

Illegal Activities: Engage in any activity that violates local, state, national, or international laws or regulations, including but not limited to laws governing data privacy, intellectual property, export control, or cybercrime.
Copyright Infringement: Bypass geographic restrictions, VPN detection systems, or access controls to unlawfully access, download, stream, or distribute copyrighted content (movies, music, software, etc.) without proper authorization.
Malicious Activities: Distribute, upload, transmit, or create malware, viruses, ransomware, spyware, trojans, worms, or any other harmful or malicious code.
Unauthorized Access: Attempt to gain unauthorized access to computer systems, networks, servers, accounts, or data belonging to others. This includes hacking, phishing, password cracking, or exploiting security vulnerabilities.
Harassment or Harm: Harass, threaten, stalk, intimidate, abuse, defame, or cause harm to any individual or entity.
Network Abuse: Engage in any activity that disrupts, interferes with, or places excessive load on our servers, the App, or networks connected to the service, including denial-of-service attacks, flooding, or spamming.
Fraud or Deception: Impersonate any person or entity, misrepresent your affiliation with any person or entity, or engage in fraudulent activities.
Child Exploitation: Create, access, store, or distribute content involving the exploitation or abuse of minors.
Terrorism or Violence: Use the service to plan, promote, or engage in terrorism, violent extremism, or activities that threaten public safety.
Resale or Redistribution: Resell, redistribute, or provide access to the App or VPN service to third parties without authorization.
Rooting/Jailbreaking Abuse: Use the App on rooted or modified Android devices in ways that bypass security features or violate these Terms.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account and access to the App, with or without notice, and may be reported to appropriate law enforcement authorities.

10. Android-Specific Provisions

Permissions:

Cybertection GuardBot requires certain Android permissions to provide security features:

Storage Access: To scan files and apps for malware
Network Access: For VPN functionality and threat database updates
Accessibility Services: For advanced threat detection (if enabled)
Device Admin: For enhanced security features (optional)
Usage Stats: To monitor app behavior for security analysis

All permissions are used solely for legitimate security purposes as described in our Privacy Policy.

Google Play Policies:

You acknowledge that your use of the App must comply with Google Play's Developer Program Policies and that Google may enforce compliance with these Terms.

Device Compatibility:

Cybertection GuardBot is designed for Android devices running Android 8.0 (Oreo) or higher. Functionality on older or modified Android versions is not guaranteed.

11. Termination

Termination by Cybertection LLC:

We reserve the right to suspend, restrict, or terminate your access to Cybertection GuardBot, with or without notice, if:

You violate any provision of these Terms of Service
You engage in prohibited activities as outlined in the Acceptable Use Policy
You use the App or VPN service for illegal purposes
Your account shows evidence of fraudulent activity
We are required to do so by law or legal process
We discontinue the App or specific features (with reasonable notice when possible)

Termination by You:

You may cancel your subscription at any time through Google Play:

Open the Google Play Store app
Tap Menu → Subscriptions
Select Cybertection GuardBot
Tap Cancel subscription

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that date.

Effect of Termination:

Upon termination or expiration of your subscription:

Your access to premium features (Real-time Shield, VPN Webguard, advanced tools) will immediately cease
You will revert to Free Tier access only
The App may remain installed on your device
Refunds are subject to Google Play's refund policy
Certain provisions of these Terms (including Sections 7, 8, 12, and 13) shall survive termination

12. Governing Law & Dispute Resolution

Governing Law:

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Maryland, United States of America, without regard to its conflict of law principles.

Jurisdiction:

Any legal action, suit, or proceeding arising out of or relating to these Terms or the App shall be instituted exclusively in the federal or state courts located in Queen Anne's County, Maryland. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Dispute Resolution:

Before filing any legal claim, you agree to first contact us at support@cybertection-guardbot.com to attempt to resolve the dispute informally. We will work in good faith to resolve any concerns.

Limitation Period:

Any claim or cause of action arising from or related to your use of the App must be filed within one (1) year after the claim or cause of action arose, or such claim shall be permanently barred.

Class Action Waiver:

To the extent permitted by law, all disputes shall be resolved on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against Cybertection LLC.

13. Changes to These Terms

Cybertection LLC reserves the right to modify, update, or replace these Terms of Service at any time at our sole discretion. Changes may be necessary due to:

Legal or regulatory requirements
New features or services
Security enhancements
Policy updates

Notice of Changes:

When we make material changes to these Terms, we will:

Update the "Last Updated" date at the top of this document
Notify you through the App via in-app notification, and/or
Send notice to the email address associated with your Google account (if provided)

Acceptance of Changes:

Your continued use of Cybertection GuardBot after changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the App and cancel your subscription.

We encourage you to review these Terms periodically to stay informed of any updates.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms of Service, together with our Privacy Policy and Google Play's Terms of Service, constitute the entire agreement between you and Cybertection LLC regarding your use of the App and supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral.
