Terms of Service: Cybertection GuardBot (Meta Quest)

Welcome to Cybertection GuardBot for Meta Quest. By downloading, installing, or using our application from the Meta Quest Store, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using the app.

1. Acceptance of Terms

By accessing or using Cybertection GuardBot ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.

2. License Agreement

This App is licensed, not sold. By downloading Cybertection GuardBot from the Meta Quest Store, you agree to Meta's Terms of Service and the Meta Quest Platform Terms, which govern your use of applications distributed through the Meta Quest Store.

In the event of any conflict between these Terms and Meta's terms, Meta's terms shall take precedence with respect to your use of the App on Meta Quest devices.

3. VR-Specific Notice

IMPORTANT VR SAFETY WARNING:

Cybertection GuardBot for Meta Quest is a security and privacy utility designed for use in virtual reality. Before using this App in VR:

Read and follow all Meta Quest health and safety warnings
Ensure you are in a safe physical environment free from obstacles, trip hazards, or fragile objects
Take regular breaks - Extended VR use can cause discomfort, eye strain, or motion sickness
Stop immediately if you experience dizziness, nausea, disorientation, blurred vision, or discomfort
Never use while operating vehicles or machinery or in situations requiring attention to physical surroundings
Supervise minors - Meta Quest devices are not designed for children under 13

The App provides security scanning and VPN features in a VR interface but does not replace proper physical awareness and safety precautions.

4. Subscription Tiers & Services

Cybertection GuardBot provides comprehensive security services through three distinct subscription tiers. Your access to specific features depends on your chosen subscription level.

Unrestricted access to all premium security modules
Priority customer support
Advanced privacy protection tools
VR privacy mode for secure browsing in virtual environments

The Free Tier is available immediately upon download. Premium features require an active subscription purchased through the Meta Quest Store.

5. In-App Purchases and Billing

All subscriptions (Basic and Pro) are processed exclusively through your Meta account via the Meta Quest Store.

Subscription Terms:

Payment: Your Meta account payment method will be charged upon confirmation of purchase.

Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected subscription plan.

Free Trial: If a Pro subscription offers a free trial period (typically 3 days), your Meta account will be charged when the free trial ends unless auto-renewal is disabled at least 24 hours before the trial expires. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Subscription Management: You can manage your subscriptions and turn off auto-renewal through your Meta Quest device or Meta account:

Go to Menu → Subscriptions
Select Cybertection GuardBot
Choose Manage or Cancel Subscription

On Web:

Select Manage subscription

Refunds: Refunds are subject to Meta's refund policy. To request a refund, contact Meta Quest Support. Cybertection LLC does not control Meta's refund decisions. Meta typically allows refunds within 14 days of purchase if you've used the app for less than 2 hours.

Price Changes: Cybertection LLC reserves the right to modify subscription pricing with advance notice. Price changes will apply to subsequent billing periods following notice to you.

6. Privacy Policy

Your privacy is extremely important to us. Our Privacy Policy describes how we collect, use, store, and protect your personal information when you use Cybertection GuardBot on Meta Quest, including our VPN Webguard service.

Meta Quest-Specific Privacy Considerations:

We do not access, collect, or store VR tracking data, hand tracking data, or spatial mapping information
We do not access your Meta social graph, friends list, or VR activity
VPN usage is encrypted and not tied to your VR activity
Security scans are performed locally on your Meta Quest device when possible

By using this App, you consent to the data practices described in our Privacy Policy.

7. Security Disclaimers & Service Limitations

CYBERTECTION GUARDBOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

While our security tools are designed with industry-leading practices to enhance your digital safety and privacy, you acknowledge and agree that:

No Absolute Protection: No security software, including Cybertection GuardBot, can provide 100% protection against all malware, viruses, cyber threats, or security vulnerabilities. New threats emerge constantly, and detection requires ongoing updates.
VR Platform Limitations: Security scanning capabilities on Meta Quest are limited compared to traditional computing platforms due to the closed nature of the Meta Quest operating system. We can scan accessible files and monitor network traffic but cannot access all system-level functions.
Scanning Limitations: Security scanning may not detect all malware, spyware, or other malicious software. Zero-day threats and sophisticated attacks may evade detection.
VPN Service: The VPN Webguard service is provided for encrypted browsing and enhanced privacy but does not guarantee complete anonymity or protection from all online threats. VPN performance may vary based on network conditions, server load, and geographic location.
Meta Quest Integration: The App operates within Meta Quest's security sandbox and permissions system. Some advanced security features available on other platforms may be limited or unavailable on Meta Quest.
Performance Impact: Security features and VPN services may impact VR performance, including frame rates and latency. The App is optimized to minimize performance impact, but some degradation may occur during active scans.
User Responsibility: You remain solely responsible for:
- Using the App in a safe physical environment
- Following Meta Quest health and safety guidelines
- Practicing safe browsing habits in VR
- Maintaining backups of important data
- Keeping your Meta Quest software updated
- Using strong, unique passwords for your Meta account
- Being aware of your physical surroundings while in VR
Service Availability: The App and its services may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control. We do not guarantee uninterrupted or error-free service.
Third-Party Content: Cybertection GuardBot may interact with third-party websites, services, or content accessed through Meta Quest Browser or other VR applications. We are not responsible for the security, privacy practices, or content of third-party services.
VR-Specific Risks: Extended use of VR security features may cause eye strain, fatigue, or discomfort. Take regular breaks and follow Meta's health and safety recommendations.

YOU ACKNOWLEDGE THAT USE OF CYBERTECTION GUARDBOT DOES NOT ELIMINATE ALL SECURITY RISKS AND THAT YOU USE THE APP AT YOUR OWN RISK.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CYBERTECTION LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

Indirect, Incidental, Special, Consequential, or Punitive Damages
Loss of Profits, Revenue, Data, or Business Opportunities
Business Interruption or System Downtime
Security Breaches, Data Loss, or Privacy Violations Occurring Despite Use of Our Software
Costs of Procurement of Substitute Services
Damages Resulting from Malware, Viruses, or Other Harmful Code Not Detected by the App
Unauthorized Access to Your Device or Accounts
Damages Arising from VPN Service Interruptions or Performance Issues
VR Performance Degradation or Frame Rate Issues
Physical Injury or Property Damage Resulting from VR Use (including but not limited to trips, falls, collisions, or injuries caused by distraction or disorientation while using the App in VR)
Health Issues Related to VR Use (including motion sickness, eye strain, headaches, or seizures)
Loss of Meta Quest Data or Content

This limitation applies regardless of the legal theory upon which any claim is based (whether contract, tort, negligence, strict liability, or otherwise), even if Cybertection LLC has been advised of the possibility of such damages.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

In jurisdictions where liability cannot be excluded, Cybertection LLC's total liability to you for all claims arising from or related to the App shall not exceed the amount you paid for the App subscription in the twelve (12) months preceding the event giving rise to liability, or $100 USD, whichever is less.

VR SAFETY DISCLAIMER: You are solely responsible for maintaining awareness of your physical surroundings while using any VR application, including Cybertection GuardBot. Always use VR in a safe environment and follow Meta Quest's safety guidelines.

9. Intellectual Property Rights

All content, features, functionality, software code, user interface design, VR interface elements, graphics, logos, trademarks, service marks, and other materials contained within Cybertection GuardBot are the exclusive property of Cybertection LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You May Not:

Copy, modify, distribute, sell, or lease any part of the App or its content
Reverse engineer, decompile, or disassemble the App software (except as permitted by applicable law)
Extract source code or attempt to derive the underlying algorithms
Remove, alter, or obscure any copyright, trademark, or proprietary notices
Create derivative works based on the App
Use the App's name, logo, or trademarks without prior written permission
Frame or mirror any part of the App without express authorization
Extract or reuse VR interface designs or elements

"Cybertection," "GuardBot," and associated logos are trademarks of Cybertection LLC. Unauthorized use is strictly prohibited and may result in legal action.

The license granted to you is limited to a non-exclusive, non-transferable, revocable right to use the App for personal, non-commercial purposes in accordance with these Terms.

Meta Quest® is a trademark of Meta Platforms, Inc. This App is not endorsed by, sponsored by, or affiliated with Meta Platforms, Inc.

10. Acceptable Use Policy

You agree to use Cybertection GuardBot only for lawful purposes and in compliance with these Terms. Specifically, you agree NOT to use the App or VPN Webguard service to:

Prohibited Activities:

Illegal Activities: Engage in any activity that violates local, state, national, or international laws or regulations, including but not limited to laws governing data privacy, intellectual property, export control, or cybercrime.
Copyright Infringement: Bypass geographic restrictions, VPN detection systems, or access controls to unlawfully access, download, stream, or distribute copyrighted content (movies, music, software, VR experiences, etc.) without proper authorization.
Malicious Activities: Distribute, upload, transmit, or create malware, viruses, ransomware, spyware, trojans, worms, or any other harmful or malicious code.
Unauthorized Access: Attempt to gain unauthorized access to computer systems, networks, servers, accounts, or data belonging to others. This includes hacking, phishing, password cracking, or exploiting security vulnerabilities.
Harassment or Harm: Harass, threaten, stalk, intimidate, abuse, defame, or cause harm to any individual or entity, whether in VR environments or otherwise.
Network Abuse: Engage in any activity that disrupts, interferes with, or places excessive load on our servers, the App, Meta Quest services, or networks connected to the service, including denial-of-service attacks, flooding, or spamming.
Fraud or Deception: Impersonate any person or entity, misrepresent your affiliation with any person or entity, or engage in fraudulent activities.
Child Exploitation: Create, access, store, or distribute content involving the exploitation or abuse of minors.
Terrorism or Violence: Use the service to plan, promote, or engage in terrorism, violent extremism, or activities that threaten public safety.
Resale or Redistribution: Resell, redistribute, or provide access to the App or VPN service to third parties without authorization.
VR-Specific Violations: Use the App to facilitate harassment or inappropriate behavior in VR social environments, or to circumvent VR platform safety features.
Platform Abuse: Attempt to bypass Meta Quest security features, sideload unauthorized content through our VPN, or use the App in ways that violate Meta's Platform Terms.

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account and access to the App, with or without notice, and may be reported to appropriate law enforcement authorities and Meta Platforms, Inc.

11. Meta Quest-Specific Provisions

System Requirements:

Meta Quest system software v60 or higher
Minimum 500 MB free storage space
Active internet connection for VPN and updates
Meta account in good standing

Permissions:

Cybertection GuardBot requires certain Meta Quest permissions to provide security features:

Internet Access: For VPN functionality, threat database updates, and cloud features
Storage Access: To scan downloaded files and apps for malware
Network Information: To monitor network traffic for threats

All permissions are used solely for legitimate security purposes as described in our Privacy Policy. We do not request or use:

Camera or microphone access
Hand tracking or controller data
Guardian boundary or spatial data
Social features or friends list access

Meta Platform Compliance:

You acknowledge that your use of the App must comply with:

Meta Quest Platform Terms of Service
Meta Quest Content Policy
Meta Quest Developer Policies (as they apply to app usage)

Meta Platforms, Inc. may enforce compliance with these Terms and has the right to remove the App from your device or the Quest Store for policy violations.

VR Performance Optimization:

The App is optimized to minimize impact on VR frame rates and latency
Real-time scanning can be scheduled during non-VR use or idle periods
VPN features are designed for background operation with minimal performance impact
You can adjust security settings to balance protection and VR performance

Data Storage:

Security scan results and quarantined files are stored locally on your Meta Quest device
Cloud sync features (if enabled) use encrypted transmission
You can clear app data at any time through Meta Quest settings

Updates and Compatibility:

The App receives updates through the Meta Quest Store
Updates may be required to maintain compatibility with Meta Quest system updates
Some features may be added, modified, or removed based on Meta platform changes

12. Termination

Termination by Cybertection LLC:

We reserve the right to suspend, restrict, or terminate your access to Cybertection GuardBot, with or without notice, if:

You violate any provision of these Terms of Service
You engage in prohibited activities as outlined in the Acceptable Use Policy
You use the App or VPN service for illegal purposes
Your account shows evidence of fraudulent activity
We are required to do so by law, legal process, or by Meta Platforms, Inc.
We discontinue the App or specific features (with reasonable notice when possible)
Your Meta account is suspended or terminated

Termination by You:

You may cancel your subscription at any time through the Meta Quest Store as described in Section 5.

You may also uninstall the App at any time:

In VR, navigate to Library → Apps
Find Cybertection GuardBot
Select Uninstall

Cancellation takes effect at the end of your current billing period. You will retain access to premium features until that date.

Effect of Termination:

Upon termination or expiration of your subscription:

Your access to premium features (Real-time Shield, VPN Webguard, advanced tools) will immediately cease
You will revert to Free Tier access only
The App may remain installed on your device but with limited functionality
Locally stored scan results and settings will remain on your device unless you uninstall the App
Refunds are subject to Meta's refund policy
Certain provisions of these Terms (including Sections 8, 9, 13, and 14) shall survive termination

13. Governing Law & Dispute Resolution

Governing Law:

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Maryland, United States of America, without regard to its conflict of law principles.

Jurisdiction:

Any legal action, suit, or proceeding arising out of or relating to these Terms or the App shall be instituted exclusively in the federal or state courts located in Queen Anne's County, Maryland. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

Dispute Resolution:

Before filing any legal claim, you agree to first contact us at support@cybertection-guardbot.com to attempt to resolve the dispute informally. We will work in good faith to resolve any concerns within 30 days.

Limitation Period:

Any claim or cause of action arising from or related to your use of the App must be filed within one (1) year after the claim or cause of action arose, or such claim shall be permanently barred.

Class Action Waiver:

To the extent permitted by law, all disputes shall be resolved on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration against Cybertection LLC.

Relationship with Meta:

You acknowledge that these dispute resolution provisions govern disputes between you and Cybertection LLC only. Disputes with Meta Platforms, Inc. regarding the Meta Quest platform, billing, or related services are governed by Meta's Terms of Service.

14. Changes to These Terms

Cybertection LLC reserves the right to modify, update, or replace these Terms of Service at any time at our sole discretion. Changes may be necessary due to:

Legal or regulatory requirements
New features or services
Security enhancements
Meta Quest platform changes
Policy updates

Notice of Changes:

When we make material changes to these Terms, we will:

Update the "Last Updated" date at the top of this document
Notify you through the App via in-VR notification, and/or
Post notice on our website at www.cybertection.net
Send notification through the Meta Quest system (if available)

Acceptance of Changes:

Your continued use of Cybertection GuardBot after changes to these Terms constitutes your acceptance of the modified Terms. If you do not agree to the updated Terms, you must stop using the App and cancel your subscription.

We encourage you to review these Terms periodically to stay informed of any updates.

15. VR Health and Safety

Your Responsibilities:

By using Cybertection GuardBot in VR, you acknowledge and agree that:

You have read and understand Meta Quest's health and safety warnings
You will use the App only in a safe physical environment
You will take regular breaks to avoid eye strain and fatigue
You will stop using the App immediately if you experience any discomfort
You are physically and mentally fit to use VR technology
If you have a history of seizures, blackouts, or epilepsy, you will consult a doctor before using VR

Age Restrictions:

Meta Quest devices are designed for users age 13 and older (or 10 and older for Quest 3 and Quest 3S with parental supervision). By using this App, you confirm that you meet the age requirements for Meta Quest usage.

Photosensitivity Warning:

A small percentage of people may experience seizures when exposed to certain lights, patterns, or images. If you or anyone in your family has an epileptic condition or has experienced seizures, consult a doctor before using VR.

Stop using the App immediately if you experience:

Seizures
Loss of awareness
Eye strain
Eye or muscle twitching
Involuntary movements
Altered, blurred, or double vision
Dizziness, disorientation, or nausea
Any other discomfort

Cybertection's Commitment:

We have designed the VR interface of Cybertection GuardBot to minimize motion sickness and discomfort, but individual experiences may vary. Our VR interface:

Avoids rapid movements and disorienting transitions
Uses comfort-mode locomotion options
Provides clear visual indicators
Minimizes use of flashing or strobing effects

However, these measures do not eliminate all VR-related health risks. You use VR features at your own risk.

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable. If modification is not possible, the provision shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms of Service, together with our Privacy Policy and Meta's Platform Terms of Service, constitute the entire agreement between you and Cybertection LLC regarding your use of the App and supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral.

18. Third-Party Beneficiaries

You acknowledge that Meta Platforms, Inc. is a third-party beneficiary of these Terms and has the right to enforce provisions related to your use of the Meta Quest platform.

20. Acknowledgment

BY DOWNLOADING, INSTALLING, OR USING CYBERTECTION GUARDBOT, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE, UNDERSTAND THEM, AGREE TO BE BOUND BY THEM, AND CONFIRM THAT YOU MEET THE AGE AND HEALTH REQUIREMENTS FOR VR USE.
