END-USER LICENSE AGREEMENT (EULA)

Thank you for choosing Cybertection. This End-User License Agreement ("EULA") is a legally binding agreement between you ("User") and Cybertection ("Company," "we," "us," or "our") governing your use of the Cybertection antivirus software ("Software"). By installing, downloading, accessing, or using the Software, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not install, download, access, or use the Software.

1. License Grant

Cybertection grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Software solely for personal, non-commercial purposes. Any unauthorized use, reproduction, distribution, or modification of the Software is strictly prohibited.

Prohibited Actions:

  • Using the Software for commercial purposes without explicit written permission.

  • Reverse engineering, decompiling, or attempting to extract the source code of the Software.

  • Modifying, altering, or creating derivative works based on the Software.

  • Reselling, sublicensing, renting, leasing, or distributing the Software to third parties.

  • Using the Software in any manner that violates applicable laws or regulations.

Violation of these terms may result in the immediate termination of this license and legal action.

2. Data Collection and Use

Cybertection is committed to protecting your privacy while enhancing your security. By using the Software, you acknowledge and agree that Cybertection may collect certain data to improve security features, optimize performance, and enhance user experience.

Types of Data Collected:

  • Technical Information: Includes device type, operating system, software version, system configurations, and network details.

  • Usage Data: Information on scan frequency, detected threats, feature interactions, and Software performance.

  • Threat Intelligence Data: Anonymized records of detected malware, phishing attempts, and other cybersecurity threats.

Data Protection Measures:

  • Cybertection does not collect data such as your address, or financial details.

  • All collected data is anonymized and aggregated to ensure privacy.

  • Data is used exclusively for security enhancements, software improvements, and threat intelligence research.

Data Sale for Enhanced Experience: To provide the best security and optimize user experience, Cybertection may share non-sensitive, anonymized, and aggregated data with trusted third parties, such as cybersecurity researchers, industry partners, and developers. This data helps improve malware detection, prevent cyber threats, and enhance overall system performance. Our commitment to privacy ensures that all transmitted data remains secure, encrypted, and fully anonymized.

3. Software Updates

To ensure optimal security and performance, Cybertection may automatically download and install updates, including:

  • Security patches to address vulnerabilities.

  • New features and improvements.

  • Bug fixes and performance enhancements.

By using the Software, you agree to receive and allow automatic updates without prior notice. Failure to install updates may result in reduced functionality or security risks.

4. Ownership and Intellectual Property

Cybertection and its licensors retain full ownership of the Software and all related intellectual property rights. This EULA does not grant you any rights, title, or interest in the Software except for the limited license explicitly stated.

5. Disclaimer of Warranty

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CYBERTECTION MAKES NO GUARANTEE THAT THE SOFTWARE WILL BE ERROR-FREE OR THAT IT WILL FUNCTION WITHOUT INTERRUPTION.

CYBERTECTION IS NOT RESPONSIBLE FOR ANY DAMAGE, DATA LOSS, OR MALFUNCTIONS CAUSED BY:

  • USE OF THE SOFTWARE WITH INCOMPATIBLE SYSTEMS.

  • IMPROPER INSTALLATION OR UNAUTHORIZED MODIFICATIONS.

  • THIRD-PARTY MALWARE OR OTHER SECURITY BREACHES.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CYBERTECTION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE. YOU AGREE THAT YOUR USE OF THE SOFTWARE IS AT YOUR OWN RISK.

CYBERTECTION IS NOT RESPONSIBLE FOR:

  • DAMAGES RESULTING FROM VIRUSES, MALWARE, OR CYBERATTACKS THAT OCCUR DESPITE USE OF THE SOFTWARE.

  • COMPATIBILITY ISSUES WITH OTHER SOFTWARE OR HARDWARE.

  • DATA LOSS OR CORRUPTION CAUSED BY MALICIOUS SOFTWARE OR USER ERROR.

7. Governing Law and Dispute Resolution

This EULA shall be governed by and construed in accordance with the laws of [Your State/Jurisdiction], without regard to conflict of law principles.

Dispute Resolution:

  • Any disputes arising under this EULA shall first be attempted to be resolved through informal negotiation.

  • If unresolved, disputes shall be settled through binding arbitration under the rules of the [Arbitration Organization].

  • Users waive the right to participate in any class-action lawsuit against Cybertection.

8. Refund and Subscription Policy

ALL SALES ARE FINAL. NO REFUNDS WILL BE ISSUED ONCE THE SOFTWARE IS PURCHASED.

Subscription Terms:

  • Your license is valid for the duration of the subscription period.

  • After expiration, you must renew your subscription to continue receiving updates and customer support.

  • If your subscription is not renewed, the Software may stop functioning or provide limited protection.

Support Policy:

  • Customer support is available for the duration of an active subscription.

  • After your subscription expires, support will only be provided upon renewal.

  • Cybertection is committed to providing excellent customer service and ensuring customer satisfaction.

9. Termination of License

Cybertection reserves the right to terminate this license if:

  • You violate any terms of this EULA.

  • Unauthorized modifications or misuse of the Software are detected.

  • You attempt to resell, sublicense, or distribute the Software without authorization.

Upon termination, you must immediately uninstall and cease all use of the Software. Cybertection may also disable the Software remotely.

10. Entire Agreement

This EULA constitutes the complete agreement between you and Cybertection regarding the Software and supersedes any prior agreements. No modifications to this EULA shall be valid unless in writing and signed by an authorized representative of Cybertection.
